Agreement to These Terms

These Terms & Conditions ("Terms") govern your access to and use of the website, courses, workshops, coaching programs, community spaces, digital resources, events, and related services offered by Unprecedented Lifestyle LLC dba Be Unprecedented ("Be Unprecedented," "we," "us," or "our").

By visiting our website, creating an account, enrolling in a program, purchasing a product or service, registering for an event, downloading resources, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services.

Who We Serve

Be Unprecedented provides resilience coaching, mindset education, workshops, courses, community support, and related resources for adults seeking personal and professional growth. Our services are intended for individuals who are at least 18 years old.

Coaching and Educational Disclaimer

Be Unprecedented is a coaching and education business. Our services are designed to support resilience, mindset, confidence, clarity, and personal growth. We do not provide psychotherapy, medical advice, legal advice, financial advice, tax advice, crisis services, or professional diagnosis or treatment.

You are responsible for your own decisions, actions, results, and well-being. If you need medical, mental health, legal, financial, or emergency support, please contact a qualified professional or emergency service provider.

No Guaranteed Results

We care deeply about client progress, but we cannot and do not guarantee any specific outcome, income, business result, career result, health result, emotional result, or personal transformation. Your results depend on many factors, including your participation, effort, circumstances, choices, and follow-through.

Testimonials, stories, examples, or case studies are shared for illustration only. They do not promise or guarantee that you will experience the same or similar results.

Accounts, Access, and Security

Some services may require you to create an account, login, profile, or member access through various platform. You agree to provide accurate information and keep your account information current.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You may not share your account, course access, community access, materials, recordings, or private links with anyone else unless we give written permission.

  • You agree to notify us promptly if you believe your account has been accessed without authorization.

  • We may suspend or terminate access if we believe an account is being misused, shared, compromised, or used in violation of these Terms.

Purchases, Payments, and Billing

When you purchase a course, coaching package, workshop, membership, event, digital resource, or other service, you agree to pay the stated price and any applicable taxes, fees, or payment processing charges. Payment terms will be presented at checkout, on an invoice, or in a written agreement.

  • Payments may be processed by third-party payment providers. We do not typically store full payment card details directly.

  • If you choose a payment plan, you authorize the scheduled charges and agree to keep your payment method current until the balance is paid in full.

  • Failed, late, disputed, or reversed payments may result in paused access, cancellation of services, additional collection efforts, or termination of your enrollment.

  • Prices, offers, promotions, and program availability may change at any time unless you already have a signed or confirmed purchase agreement that states otherwise.

Refunds, Cancellations, and Rescheduling

Refunds, cancellations, rescheduling, missed sessions, and transfer requests are governed by the specific policy stated at checkout, in the program description, in the event registration details, or in a separate client agreement. If no separate written policy is provided, purchases are generally non-refundable once access, materials, services, or live sessions have begun.

For 1:1 coaching or private sessions, please provide as much notice as possible if you need to reschedule. We may treat missed appointments, late cancellations, or repeated rescheduling as completed sessions, depending on the specific program or client agreement.

If a workshop, course, live session, or event must be rescheduled or canceled by us, we may offer a replacement date, credit, transfer, or refund at our discretion unless otherwise required by law.

Subscriptions, Memberships, and Recurring Payments

If we offer subscriptions, memberships, payment plans, or recurring billing, the billing frequency, amount, renewal terms, cancellation method, and access rules will be stated at checkout or in the applicable offer. By enrolling in a recurring payment offer, you authorize us or our payment provider to charge your payment method according to those terms until canceled or completed.

You are responsible for canceling before the next billing date if you do not want to continue. Cancellation generally stops future charges but does not automatically refund prior payments unless the offer or applicable law states otherwise.

Community Participation and Conduct

Group programs, workshops, live sessions, and community spaces are designed to be respectful, constructive, and supportive. By participating, you agree to communicate with care and professionalism.

  • Do not harass, threaten, shame, bully, defame, exploit, spam, or discriminate against others.

  • Do not share another participant's private story, identity, screenshots, recordings, comments, or personal information outside the program or community.

  • Do not promote unrelated products, services, opportunities, or solicitations unless we invite or approve it.

  • Do not upload or share content that is unlawful, harmful, abusive, misleading, infringing, confidential, or otherwise inappropriate.

  • We may remove content, limit participation, or terminate access if community standards are violated.

Confidentiality in Coaching and Group Settings

We treat client information with care and discretion. However, group programs, workshops, communities, live chats, and shared online spaces involve other participants. You understand that anything you voluntarily share in a group setting may be seen or heard by others.

We ask all participants to respect confidentiality, but we cannot guarantee the actions of other participants. Please use your judgment when sharing personal, business, financial, health, employment, or family information.

Intellectual Property

All content, materials, frameworks, methods, worksheets, videos, recordings, downloads, templates, prompts, guides, course content, workshop content, brand elements, copy, designs, and other materials provided by Be Unprecedented are owned by us or licensed to us, unless otherwise stated.

This includes the Be Unprecedented brand and the E.V.A. Method. You may use purchased or provided materials for your personal, non-commercial learning and development only. You may not copy, reproduce, distribute, sell, license, teach, publish, upload, record, share, or create derivative works from our materials without written permission.

Limited License to Use Materials

When you purchase or access our services, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to access and use the applicable materials for your own personal development. This license does not transfer ownership of any intellectual property.

Recordings, Replays, and Participant Content

Some live sessions, workshops, classes, or community events may be recorded and made available as replays. By participating in recorded sessions, you understand that your name, voice, image, chat comments, questions, or shared content may appear in the recording unless you choose to participate without video, use a display name, or avoid sharing identifying information.

If you submit comments, questions, posts, testimonials, feedback, or other content, you represent that you have the right to share it. You grant us permission to use submitted content as needed to operate the service, provide support, manage the community, improve offerings, or, with your consent where appropriate, share testimonials or promotional content.

Testimonials, Reviews, and Marketing

We may ask for feedback, reviews, or testimonials. We will not intentionally misrepresent your experience. If we use your name, image, likeness, or detailed personal story in marketing, we will seek appropriate permission. You may ask us to stop using a testimonial where reasonably possible, though prior uses may not always be fully removable from materials already published, distributed, or archived.

User Responsibilities

You agree to use our services lawfully, respectfully, and in good faith. You agree not to:

  • Use our services for unlawful, harmful, fraudulent, abusive, or misleading purposes.

  • Interfere with the security, functionality, or availability of our website, The Hub, or related platforms.

  • Attempt to access accounts, systems, content, or data you are not authorized to access.

  • Share login credentials, private links, paid resources, recordings, or member-only content without permission.

  • Use our content, programs, or materials to create a competing product, course, workshop, coaching program, or service.

Third-Party Tools, Links, and Platforms

Our services may rely on or link to third-party tools and platforms, such as website hosting, payment processors, email marketing tools, scheduling tools, Zoom, Google Workspace, social media platforms, analytics tools, or other service providers. Third-party platforms have their own terms, privacy policies, fees, features, outages, and security practices. We are not responsible for third-party websites, platforms, content, actions, errors, or availability.

Technology, Availability, and Access

We aim to provide reliable access, but we do not guarantee that our website, courses, community spaces, downloads, replays, or live sessions will always be available, uninterrupted, secure, or error-free. We may update, modify, pause, discontinue, or restrict access to any part of our services at any time.

Privacy

Your use of our services is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, store, and share personal information.

Limitation of Liability

To the fullest extent permitted by law, Be Unprecedented, its owner, team members, contractors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost opportunities, loss of data, business interruption, emotional distress, or other damages arising from or related to your use of our services.

To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to us for the specific product or service giving rise to the claim during the three months before the claim arose, or $100 if no payment was made.

Indemnification

You agree to defend, indemnify, and hold harmless Be Unprecedented, its owner, team members, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from your use of our services, your violation of these Terms, your violation of another person's rights, or content you submit or share.

Termination

We may suspend or terminate your access to our services, programs, community, account, materials, or communications if you violate these Terms, fail to make required payments, misuse our content, disrupt the community, or act in a way that may harm Be Unprecedented, other participants, or our business operations.

Termination does not eliminate your obligation to pay outstanding amounts or comply with provisions that should reasonably survive termination, including intellectual property, confidentiality, payment obligations, limitations of liability, indemnification, and dispute provisions.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Florida, without regard to conflict-of-law rules. Before filing a claim, both parties agree to make a good-faith effort to resolve the matter informally by contacting each other in writing.

Any legal claim, dispute, or proceeding arising from or related to these Terms or our services will be brought in the state or federal courts located in Palm Beach County and Florida, unless another dispute resolution process is required by a separate written agreement or applicable law.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a revised "Last Updated" date. Your continued use of our website, The Hub, programs, products, or services after updated Terms are posted means you accept the updated Terms.
